GOA and VCDL Seek An Injunction Against Northam’s Gun Ban

ImageWhy Second Amendment Sanctuaries Are Important In Virginia & the U.S., iStock-884220580Richmond, VA-(Ammoland.com)- On Wednesday, Virginia Governor Ralph Northam issued a state of emergency in direct response to the VCDL Lobby Day that is taking place on Monday, January 20th. The state of emergency bans all weapons, including guns, from Capitol Square from Friday night until Tuesday morning. The emergency action will also ban items like helmets and shields. In the Governor's press conference, Northam claimed he was worry about another Charlottesville happening in Richmond. In Charlottesville, white nationalists and Antifa clashed at the “Unite the Right Rally”. There was widespread violence. Many observers blamed the Governor and the police for the violent outbreaks. The Governor used his emergency powers to cancel the rally after the participants gathered to hear the speakers, and then the police funneled the white nationalist out of the park where they gathered directly into the waiting Antifa mob. The two groups started clashing with each other and fighting. The rally ended on the death of Heather Heyer at the hands of a car driven by a white nationalist. White nationalist groups are not part of the VCLD's Lobby Day. The only issue discussed on Lobby Day by the attendees is gun rights. The local Antifa group has also spoken out against the Democrat's anti-gun bills. Even though there has never been violence at any Lobby Day in the past, the Governor still insists his ban is necessary. He claims it is for the safety of the lawmakers and the public. Most attendees at Lobby Day will have conceal handgun permits which means they have been through extensive criminal background checks. CHP holders have a much lower crime rate than the general population. “No weapons will be allowed on capitol grounds. This includes everything from sticks and bats to chains and projectiles,” Northam said at the press conference. The Governor claims Virginia agencies have received credible threats against the Democrat-controlled government. Northam didn't say what the danger was or who was making the threats. The Virginia State Police referred AmmoLand to the Governor's office for information about the threats. They were not able to confirm or deny the Governor’s claims. In response to the ban, Gun Owners of America and the Virginia Citizens Defense League have asked the court to issue an injunction to stop the gun ban from going into effect. At the heart of the request is a 2012 law that prevents the Governor from banning guns by using a state of emergency. Complaint and Application for Temp Injunction as FILED GOA is arguing that the Governor’s actions violate the Virginia and U.S. Constitutions, as well as, a 2012 state law which strictly limits the governor’s ability to ban gun in a state of emergency. “Governor Northam is behaving like the royal governors who long preceded him,” Erich Pratt, Senior Vice President of Gun Owners Of America said, “He has arrogantly and brazenly tried to restrict the rights protected to Virginians by the First and Second Amendments. For this reason, Gun Owners of America is joining VCDL in asking the courts to issue an emergency injunction forbidding the enforcement of the Governor’s unlawful ban. The Lobby Day rally is held annually with thousands of participants and without incident. The only difference this year is that, in response to the Democrats’ attempt to eviscerate the Second Amendment, a much larger crowd is expected.” The Governor and the Democrat-controlled legislature have made gun-control their key issue. Michael Bloomberg dumped millions into the Virginia elections to seize control of the Commonwealth. The Democrats put into power by the anti-gun groups have an utter disdain for gun owners. Senator Dave Marsden went as far as calling gun owners little kids and insisting that they have mental issues. On Monday, an estimated 50,000 to 120,000-gun owners will descend on Richmond to lobby their representatives for gun rights and to attend a pro-gun rally. More than 60 buses from around the state are coming to the Capitol. Other buses are coming from states as far as Connecticut. Around the state, the Second Amendment Sanctuary movement has taken off. As of this writing, over 96% of the Commonwealth has declared that they will not enforce unconstitutional gun laws. There has been no violence at any of these hearings.
